Terms of Sale<\/h2>\n<\/div>\n\n\n\n

Effective as of 22.06.2023.
The owner of the online store https:\/\/puhastusekspert.ee\/pood\/<\/a><\/strong> (hereinafter the Online Store<\/em>) is Osa\u00fching Puhastusekspert<\/strong>, registry code 10487204, address Renneoru 4, 46202 V\u00e4ike-Maarja, L\u00e4\u00e4ne-Viru County (hereinafter Puhastusekspert<\/em>).<\/div>\n\n\n\n

Validity of the sales agreement, product, and pricing information<\/h2>\n\n\n\n
1.1.<\/strong> These terms of sale apply to the purchase of goods and services (hereinafter Goods<\/em>) from the Online Store. The sales agreement is considered concluded between the Buyer and Puhastusekspert<\/strong>.
1.2.<\/strong> The prices and information for Goods sold in the Online Store are displayed on the respective product page. Images are for illustrative purposes only.
1.3.<\/strong> All prices of Goods in the Online Store are in euros and include 24% VAT (except for books, which have 9% VAT). Published prices are valid at the time of purchase.
1.4.<\/strong> A delivery fee is added to the price of the Goods, depending on the chosen delivery method. The delivery fee is shown to the Buyer during the order process.
1.5.<\/strong> If a discount applies to the purchase of Goods (e.g., using a discount code), the discount is calculated after entering the relevant discount information in the shopping cart.<\/div>\n\n\n\n

Order placement and payment<\/h2>\n\n\n\n
2.1.<\/strong> To order Goods, add the desired items to the shopping cart. Quantities can be adjusted, and items can be removed from the cart until payment is completed.
2.2.<\/strong> To place an order, fill in the required information fields and select a suitable delivery method. The total amount payable will then be displayed, which can be paid via bank link or another payment solution. Note:<\/strong> When paying via bank link, the Buyer must click the \u201cReturn to Merchant\u201d button on the bank\u2019s page.
2.3.<\/strong> The order is considered final, and the sales agreement is concluded once the payment has been received in Puhastusekspert<\/strong>\u2019s account. The Buyer pays the full price of the Goods and delivery fee in advance.
2.4.<\/strong> The Online Store will send an order confirmation to the Buyer\u2019s email address. Upon fulfillment of the order, the Buyer will additionally receive an invoice and a shipment tracking code by email.
2.5.<\/strong> If the ordered Goods cannot be delivered (e.g., due to stock depletion), Puhastusekspert<\/strong> has the right to cancel the order. The Buyer will be notified as soon as possible, and the paid amount (including delivery costs) will be refunded within 14 days of notification. In the case of partial cancellation, Puhastusekspert<\/strong> may ask the Buyer to clarify their preference for the remaining items \u2014 whether to deliver them or cancel them as well.<\/div>\n\n\n\n

Delivery<\/h2>\n\n\n\n
3.1.<\/strong> Goods from the Online Store can be ordered within the territory of the Republic of Estonia.
3.2.<\/strong> The Buyer selects a suitable delivery method in the shopping cart. Goods can be delivered via different service providers, and the Buyer can choose the provider in the shopping cart view.
3.3.<\/strong> Delivery costs are borne by the Buyer, and the corresponding price information is displayed alongside the chosen delivery method in the shopping cart.
3.4.<\/strong> Goods generally arrive at the destination specified by the Buyer within 5 working days from the date the sales agreement comes into effect.
3.5.<\/strong> Puhastusekspert<\/strong> is not responsible for the reliability of the delivery service provided by the chosen company.
3.6.<\/strong> Access to the e-learning course is granted to the Buyer immediately after the sales agreement enters into force in the LearnDash learning environment. Access to the e-learning course is not time-limited.<\/div>\n\n\n\n

Right of withdrawal<\/h2>\n\n\n\n
4.1.<\/strong> After receiving the Goods, the Buyer has the right to withdraw from the contract concluded in the Online Store within 14 days.
4.2.<\/strong> To exercise the 14-day withdrawal right, the Buyer must not use the Goods in any way other than necessary to verify their nature, characteristics, and functioning, as would be allowed when testing the Goods in a physical store.
4.3.<\/strong> If the Goods have been used for purposes other than verifying their nature, characteristics, and functioning, or show signs of use or wear, Puhastusekspert<\/strong> has the right to proportionally reduce the refundable amount according to the decrease in the Goods\u2019 value.
4.4.<\/strong> Costs related to returning the Goods are borne by the Buyer, except when the reason for return is that the Goods do not conform to the order (e.g., incorrect or defective product).
4.5.<\/strong> To return the Goods, the Buyer must submit a withdrawal request to Puhastusekspert<\/strong> no later than 14 days from the receipt of the Goods or provide proof that the Goods were handed over to the carrier within this period. The withdrawal request can be sent via email to info@puhastusekspert.ee<\/a><\/strong>.
4.6.<\/strong> The 14-day withdrawal right does not apply if:
4.6.1.<\/strong> The Buyer is a legal entity;
4.6.2.<\/strong> The purchased Goods contain digital content, unless the Goods have not yet been made available to the Buyer or Puhastusekspert<\/strong> determines that the Buyer has not started using the digital content within the 14-day withdrawal period. Examples include e-learning courses and digital study materials;
4.6.3.<\/strong> The Goods are produced on a custom order.
4.7.<\/strong> Puhastusekspert<\/strong> will refund all amounts received from the Buyer under the contract without undue delay, but no later than 14 days from receipt of the withdrawal request. Refunds do not include fees paid to third parties, especially fees related to installment payments.
4.8.<\/strong> Puhastusekspert<\/strong> may withhold the refund until the Goods have been received or until the Buyer has provided proof of shipment, whichever occurs first.
4.9.<\/strong> If the Buyer has chosen a delivery method other than the cheapest standard delivery offered by the Online Store, Puhastusekspert<\/strong> is not obliged to refund costs exceeding the standard delivery fee.
4.10.<\/strong> Puhastusekspert<\/strong> reserves the right to cancel the sales transaction and demand the return of the Goods if the price listed in the Online Store is significantly below the market price due to an error.<\/div>\n\n\n\n

Right to submit a claim<\/h2>\n\n\n\n
5.1.<\/strong> Upon receiving the Goods, the Buyer is obliged to immediately check the conformity and quality of the Goods. Any non-conformities must be reported to Puhastusekspert<\/strong> within 15 days at info@puhastusekspert.ee<\/a><\/strong>.
5.2.<\/strong> The Online Store is responsible for any non-conformity or defect in the Goods sold to the Buyer that existed at the time of delivery and becomes apparent within two years from delivery. For the first six months after delivery, it is presumed that the defect existed at the time of delivery. Puhastusekspert<\/strong> is responsible for disproving this presumption.
5.3.<\/strong> A consumer Buyer has the right to contact Puhastusekspert<\/strong> regarding a defect no later than two months after discovering it, at info@puhastusekspert.ee<\/a><\/strong>.
5.4.<\/strong> Puhastusekspert<\/strong> is not responsible for defects that occur after the Goods have been delivered to the Buyer.
5.5.<\/strong> If Goods purchased from the Online Store have defects for which Puhastusekspert<\/strong> is responsible, Puhastusekspert<\/strong> will repair or replace the defective Goods. If repair or replacement is not possible, Puhastusekspert<\/strong> will refund the Buyer all payments made under the sales agreement.
5.6.<\/strong> Puhastusekspert<\/strong> will respond to the Buyer\u2019s claim in writing or in a form that can be reproduced in writing within 15 days.<\/div>\n\n\n\n

Processing of personal data<\/h2>\n\n\n\n
6.1. The processing of personal data is governed by the Privacy Policy.<\/a><\/div>\n\n\n\n

Dispute resolution<\/h2>\n\n\n\n
7.1.<\/strong> In case of non-conformity of the Goods with the contract, the Buyer is entitled to rely on the legal remedies provided by law:
7.1.1.<\/strong> Request that Puhastusekspert<\/strong> delivers Goods conforming to the contract;
7.1.2.<\/strong> Request compensation from Puhastusekspert<\/strong> for any damages incurred;
7.1.3.<\/strong> Withdraw from or terminate the contract;
7.1.4.<\/strong> Reduce the price;
7.1.5.<\/strong> In case of delay in fulfilling a monetary obligation, demand interest.
7.2.<\/strong> If the Buyer has claims regarding the Online Store, please contact Puhastusekspert<\/strong> at info@puhastusekspert.ee<\/a><\/strong>.
7.3.<\/strong> If the Buyer and Puhastusekspert<\/strong> cannot resolve a dispute through agreement, the dispute shall be settled at first instance in the Harju County Court<\/strong> under the laws of the Republic of Estonia. Jurisdiction is agreed, including cases where the Buyer moves abroad after the agreement is concluded, transfers their place of business or residence abroad, or if their place of activity, residence, or location is unknown at the time of filing a claim.
7.4.<\/strong> In addition, a consumer Buyer may contact the Consumer Disputes Committee<\/strong>, which has the competence to resolve disputes arising from the contract between the Buyer and Puhastusekspert<\/strong>. Review of the complaint by the committee is free of charge.
7.5.<\/strong> A consumer Buyer may also use the European Union platform for online dispute resolution<\/strong>.<\/div>\n\n\n\n

Validity and modification of terms<\/h2>\n\n\n\n
8.1.<\/strong> Puhastusekspert<\/strong> reserves the right to modify these terms of use. Updated terms will be made available on the Puhastusekspert Online Store<\/strong>. The terms applicable to a transaction are those in effect at the time the transaction is made.
